SMS Privacy Policy

How Ferguson Electric, Inc. collects, uses, and protects mobile numbers and related information for optional employee text updates (office announcements, storm notices, and callout notices).

Ferguson Electric, Inc. (“Ferguson,” “we,” “us,” or “our”) respects your privacy. This SMS Privacy Policy explains how we handle mobile phone numbers and related information when you interact with our text messaging program for Ferguson Electric employees. This policy applies to SMS/MMS communications sent by or on behalf of Ferguson Electric, Inc. The Program provides optional text updates such as office announcements and storm or callout notices. It is limited to the Program and does not replace any separate company privacy or information-security policy that may apply to our website, employment records, or other systems.

Non-sharing of mobile information: No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties except as required to deliver the messaging service. Information sharing with service providers who help us operate the Program — such as our messaging platform, wireless carriers, or customer-support tools — is permitted only as needed to send and receive messages, provide support, or meet legal obligations.

1. Information We Collect

In connection with our SMS program, we may collect:

  • Mobile phone numbers you provide when you voluntarily enroll as a Ferguson Electric employee
  • Your name, employee or role information, and related workplace contact details
  • Opt-in / opt-out status and consent records (including signed physical forms)
  • Message content, media sent or received (including MMS photos), delivery status, timestamps, and related messaging metadata
  • Keywords you text to us (for example, STOP, HELP, or START)

2. How We Use Information

We use mobile numbers and related information to:

  • Send optional employee text updates, including office announcements and storm or callout notices
  • Respond to inbound messages and provide support
  • Honor opt-out and help requests
  • Maintain records required for compliance, security, and service delivery
  • We use Program information only for these purposes. We do not use SMS opt-in data to add you to an unrelated marketing list or to authorize texts from an unaffiliated company

3. Mobile Information Sharing

We do not sell mobile phone numbers. We do not share mobile phone numbers or SMS opt-in consent with third parties or affiliates for their own marketing or promotional purposes.

No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties except as required to deliver the messaging service.

We may share information with service providers who help us operate the messaging program (for example, telecommunications and messaging platform providers), solely as needed to send and receive messages, provide support, or meet legal obligations. Those providers are permitted to use the information only to perform services for us. We may also disclose information if required by law, regulation, legal process, or to protect the rights, safety, or property of Ferguson Electric, Inc., our personnel, or others.

4. Message Frequency & Rates

Message frequency varies and may be higher during a storm or callout. Message and data rates may apply according to your mobile carrier plan, including for MMS. Ferguson Electric, Inc. does not charge a separate fee for SMS or MMS messages, but your carrier’s standard messaging and data rates may apply.

5. Opt-Out, Help & Consent

You can cancel the SMS service at any time by texting STOP. After we receive a valid request, we will send a confirmation and you will no longer receive SMS/MMS messages from that program. Text HELP for assistance. For additional support, call 855-852-2010 or email info@fergusonelectric.com.

Consent to receive text messages is optional and is not a condition of employment with Ferguson Electric, Inc. Employees who prefer not to use the Program may decline to opt in. You may opt in again by completing a new consent form or by following other enrollment instructions we provide. We retain opt-out records so that we do not text a suppressed number again for the Program.

6. Data Security

We use administrative, technical, and organizational safeguards designed to protect mobile numbers and related messaging information against unauthorized access, loss, or misuse. Those safeguards include limiting access to personnel and vendors who need the information to operate the Program, using contractual controls with our messaging provider, and using industry-standard protections such as encryption in transit. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Retention

We retain Program records only as long as needed for the purposes described in this policy, unless a longer period is required by law, a project requirement, or a legal hold.

Consent and opt-in records: at least four (4) years after the last Program message to that number.

Opt-out and suppression records: at least four (4) years after the opt-out, and longer if needed to prevent further messaging.

Message logs, delivery receipts, and related metadata: twelve (12) to twenty-four (24) months, unless a longer period is required.

Help and support tickets about the Program: in accordance with our ordinary customer-record retention practices.

8. Children’s Privacy

Our SMS program is intended for Ferguson Electric employees age 18 and older. We do not knowingly collect mobile information from children under 18 for this program. If we learn that we have collected Program information from a minor, we will delete it and stop messaging that number.

9. Sensitive Information

Please do not text Social Security numbers, payment card data, account passwords, or medical information. If a message includes workplace locations, storm or callout details, schedules, access instructions, or photos, treat that content as business-confidential and do not forward it except as needed for work.

10. Changes to This Policy

We may update this SMS Privacy Policy from time to time. The “Last updated” date at the top of this page will reflect the most recent revision. If a change is material to how we use or share mobile numbers or consent data, we will provide additional notice as required and obtain any new consent that is needed. Continued participation in the SMS program after non-material changes are posted constitutes acceptance of the updated policy.
